Terms of Sale

Introduction
These Terms of Sale govern the contractual relationship between Duchessence, accessible at https://duchessence.com (the “Website”), and its customers in connection with the online sale of products.

By placing an order on the Website, you agree to be bound by these Terms of Sale in addition to our Terms of Use and Privacy Policy. Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law.

2. Scope and acceptance of these Terms

These Terms of Sale apply to all online sales of products made through the Website to individual consumers for personal use and not for resale.

By confirming your order on the Website, you acknowledge that you have read, understood and accepted these Terms of Sale. If you do not agree, you must not place an order.

In the event of any inconsistency between these Terms and any other document or communication, these Terms will prevail, except where otherwise required by the Australian Consumer Law.


3. Products

The products offered for sale on the Website include shower accessories, in particular exfoliating shower towels.

We take reasonable care to ensure that product descriptions, images and other information are accurate and up to date. However:

  • product images are for illustrative purposes only,

  • colours and appearances may vary slightly depending on your device, and

  • minor variations or updates to materials or packaging may occur over time.

This does not affect your rights under the Australian Consumer Law.


4. Prices

Unless otherwise indicated, prices:

  • are shown in Australian dollars (AUD),

  • include GST where applicable, and

  • do not include shipping costs, which are shown separately at checkout.

We may change prices at any time. The price applicable to your order is the price displayed on the Website at the time you confirm the order.

If we discover an obvious pricing error after you place an order, we may contact you to give you the choice between:

  • reconfirming the order at the correct price, or

  • cancelling the order and receiving a refund.


5. Orders

To place an order:

  1. Add the desired product(s) to your cart.

  2. Go to checkout and enter your contact, billing and delivery details.

  3. Review your order summary, including products, prices, shipping fees and any applicable taxes.

  4. Confirm your order and proceed to payment.

By placing an order, you make an offer to purchase the products listed in your cart. We will send you an email acknowledging receipt of your order. This email does not constitute acceptance of your offer.

Your order is accepted, and a contract is formed, when we send you a shipping confirmation or when the products are dispatched, whichever occurs first.

We reserve the right to decline or cancel an order, for example if:

  • the product is out of stock,

  • there is an error in the price or description,

  • we suspect fraudulent or abusive activity, or

  • we are unable to deliver to the address provided.

If your order is cancelled after payment, we will refund any amounts paid for the cancelled items.


6. Payment

Payment for products is made through the secure payment methods offered at checkout, including (as available):

  • major credit and debit cards,

  • Apple Pay, Google Pay,

  • other methods enabled via Shopify Payments, and

  • Afterpay (or other “buy now, pay later” options) where available.

The total amount of your order is due and payable in full at the time you place your order. Your order will not be dispatched until payment has been successfully processed.

You must ensure that you are authorised to use the chosen payment method.


7. Shipping and delivery

Products are delivered to the delivery address you provide during checkout. Please ensure that your address is complete and accurate.

  • Processing times: orders are usually prepared and dispatched within 0–3 business days after confirmation and payment.

  • Estimated delivery times within Australia: generally 2–7 business days from dispatch, depending on your location and the carrier.

These timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by carriers or events beyond our reasonable control (for example, strikes, extreme weather, peak periods).

Risk of loss in the products passes to you when they are delivered to the address you provided. Title in the products passes to you once we have received full payment.

8. Returns, refunds and change of mind

Our returns and refunds process is described in detail in our Returns & Exchanges Policy.

In summary:

  • Because our products are used on the body, we cannot generally accept returns of opened or used products for change-of-mind reasons, except as provided under our Satisfaction Guarantee or where required by the Australian Consumer Law.

  • For unused products in resalable condition, you may contact us within a specified period to request a return, subject to the conditions set out in the Returns & Exchanges Policy.

  • Unless otherwise stated, return shipping costs for change-of-mind returns are your responsibility.

These terms do not limit your rights under the Australian Consumer Law.


In addition to your statutory rights, we offer a 90‑day satisfaction guarantee on eligible products purchased via our Website, as described in our Returns & Exchanges Policy. Under this guarantee, you may request an exchange or refund within 90 days, subject to the conditions listed there.

Separately, our products come with guarantees that cannot be excluded under the Australian Consumer Law. If a product has:

  • a major failure, you are entitled to a replacement or refund, and may also be entitled to compensation for any other reasonably foreseeable loss or damage;

  • a minor failure, we may choose to repair or replace the product or provide a refund.

If you believe a product is faulty, not of acceptable quality, not fit for purpose or does not match its description, please contact us promptly at contact@duchessence.com so we can assist you in line with your rights under the Australian Consumer Law.


10. Limitation of liability

To the maximum extent permitted by law, and except as required by the Australian Consumer Law or other non‑excludable provisions:

  • we are not liable for any indirect, incidental or consequential loss or damage arising out of or in connection with your use of the Website or the purchase or use of any product, and

  • our total aggregate liability in connection with any claim relating to a product will not exceed the amount you paid for that product.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees or other rights you may have under the Australian Consumer Law or any other law that cannot be lawfully excluded or limited.

Personal information collected in connection with your order is handled in accordance with our Privacy Policy, available at:

12. Governing law and jurisdiction

These Terms of Sale and any disputes arising out of or in connection with them are governed by the laws of New South Wales, Australia.

You agree to submit to the non‑exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
